Terms & Conditions (AGB)
1. Scope
These General Terms and Conditions apply to all contracts concluded between Helfenstein Commerce GmbH ("we", "us") and the customer ("you") via the online shop at helfensteincommerce.com. Deviating conditions of the customer are not recognized unless we expressly agree to their validity in writing.
2. Contract Formation
The presentation of products in our online shop does not constitute a legally binding offer, but a non-binding invitation to place an order. By clicking the "Order with obligation to pay" button, you place a binding order for the products in the shopping cart. We confirm receipt of your order by email immediately. A binding contract is concluded when we confirm shipment of the goods in a separate email.
3. Prices and Shipping Costs
All prices shown are in US Dollars and include the statutory value added tax (VAT). Shipping costs are added and are clearly displayed before final order confirmation. Shipping is free for orders over $75.
4. Payment
Payment is made through one of the methods offered at checkout: credit/debit card, PayPal, Klarna, Apple Pay, Google Pay, or SEPA Direct Debit. The amount is charged upon order placement (or as specified by the chosen provider).
5. Delivery
Delivery is made to the address you provide. Standard delivery times are 3–5 business days within the US and 5–10 business days internationally. We reserve the right to make partial deliveries.
6. Right of Withdrawal
Consumers have a statutory right of withdrawal. Details are set out in our Right of Withdrawal notice.
7. Warranty
The statutory warranty rights apply. The warranty period for new goods is two (2) years from delivery.
8. Liability
We are liable without limitation for damages caused intentionally or through gross negligence, as well as for damages resulting from injury to life, body, or health. In other cases, our liability is limited to typical, foreseeable damages.
9. Applicable Law and Jurisdiction
These terms and the contractual relationship are governed by the law of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods. The place of jurisdiction for all disputes is Hannover, Germany, where permitted by law.
10. Severability
If any provision of these terms is or becomes invalid, the validity of the remaining provisions shall remain unaffected.
